不動產繼承有狀空！繼承千萬房產 結果「房貸」繳不出來怎麼辦？

許多人在父母親過世後，順理成章繼承長輩名下房產，若房貸 尚未繳清，此時該如何脫身？30歲的王俊雄，面對年邁老父離世，難過之餘發現父親名下有棟位在台北市價值3000萬的不動產 ，萬萬沒想到房子房貸壓力也一併傳承，月薪僅五萬元的王俊雄，繼承房產就得扛起房貸壓力，他究竟該繼承亦或選擇拋棄繼承呢？

關於長輩房貸債留子孫的難題，律師點出常見的兩大狀況

狀況1：父母房貸還沒繳完就離世，子女如何處理剩餘房貸？

繼承房產是遺產、房貸是債務。恩典法律事務所律師周依潔表示，當繼承人在繼承時若發現債務大於遺產，會主張「拋棄繼承」，換言之，遺產、債務統統放棄繼承之意。但房貸屬於特殊情況，「除非父母有其他債務，否則房貸不會高於房屋的價值」。

周依潔說，對銀行來說，每月必須收取足額還款金，繼承人需按月繳付，若繼承人因爭產喬不攏、繳不出房貸，銀行會先按程序催繳，再用房子設定抵押權，銀行會進行強制執行拍賣房屋程序。

因此她建議，繼承人若能力所及，每月一定要繳貸款，多數人面對房產不會辦理拋棄繼承，如果實在繳不出，最好選擇自行出售房產，切莫等到房子進入銀行拍賣程序，拍賣價低於自行出售的市場行情價，如此會是筆不小的損失。

狀況2：父母過世孩子繼承房產，突然冒出3000萬債務，子女該怎麼辦？

王俊雄繼承父親房產1000萬元，繼承當時以為沒有債務，但卻在規定辦理拋棄繼承的3個月後，債主出現，3000萬債務遠大於房產1000萬價值。律師周依潔表示，此時王俊雄可採用限定繼承，限定繼承就是以「所繼承資產為上限償還債務」，為的是可避免父債子還的情形再次發生，保障繼承人權益。

所以這個案例中，面對3000萬債務，王俊雄只需還房產價值的等值金額，也就是1000萬元。

繼承遺產前得留意 先繳清「遺產稅 」

周依潔提醒，繼承房產前還需留意「遺產稅」。她舉例，倘若父母離世後，名下有一房產，子女依法繼承，但在取得前，依法規定須繳一筆遺產稅，「繳完稅房子才能繼承，課稅依公告現值計算」。

若以目前台北市土地公告現值不斷上調來說，2000萬至3000萬不動產，恐需繳超過百萬元稅金，她建議，為避免繼承卡關窘境，父母在做繼承規劃時，可幫子女預留一筆稅源。

父母除了留現金讓子女方便繳稅，不少長輩亦會利用保單，由於「保單」可節稅，要保人離世後，指定受益人可馬上領到保險金；再者，如果父母帳戶有錢，繼承人可先向國稅局申請動用父母存款繳稅，否則一般情況需繳完遺產稅才能動用父母帳戶。
